Vacation in the U.S. Sweepstakes

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Vacation in the U.S. Sweepstakes (the “Sweepstakes”) is open to legal residents of the forty-eight (48) contiguous United States (including the District of Colombia) who have reached the age of majority in their state of residence at the time of entry. Void in AK, HI and where prohibited. Employees of LePage’s 2000 Incorporated (“Sponsor”) and ShortStack (“Administrator”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, suppliers, as well as the immediate family (spouse, parents, siblings and children) and household members, whether or not related, of each such employee are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: LePage’s 2000 Incorporated, 12900 South Huron River Dr., Romulus, MI 48174 Administrator: ShortStack, 201 W. Liberty St., STE LL-1, Reno, NV 89501.

3. Timing: The Sweepstakes begins at 12:00:00 a.m. Eastern Time (“EST”) on November 15, 2013 and ends at 11:59:59 p.m. EST on February 28, 2014 (the “Sweepstakes Period”). The Sweepstakes Period will be divided into two (2) entry periods. The first entry period begins at 12:00:00 a.m. EST on November 15, 2013 and ends at 11:59:59 p.m. EST on January 15, 2014 (the “First Entry Period”). The second entry period begins at 12:00:00 a.m. EST on January 16, 2014 and ends at 11:59:59 p.m. EST on February 28, 2014 (the “Second Entry Period”). Administrator’s computer is the official time keeping device for this Sweepstakes.

4. To Enter: To participate, an entrant must have a Facebook account at the time of entry. If an entrant does not have a Facebook account, entrant may sign up for a free account at www.facebook.com. To enter visit www.facebook.com/bandittapegun.com (the “Bandit Tapegun Page”) during the Sweepstakes Period and complete the following steps: (a) follow the onscreen instructions to complete the entry form, (b) “Like” the Bandit Tapegun Page if you have not yet done so, (c) electronically agree to the Official Rules, and (d) follow the onscreen instructions to submit your entry form. LIMIT ONE (1) ENTRY PER PERSON.

Entries received during the First Entry Period are eligible for the First Entry Period and Grand Prize drawings. Entries received during the Second Entry Period are eligible only for the Grand Prize drawing. Use of any automated system to participate in the Sweepstakes is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries, which will be disqualified. In the event of a dispute as to the identity of any entrant, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned the email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder.

5. Prizes:

1. The first one hundred (100) people who enter the Sweepstakes will each receive one (1) Bandit® Tapegun. The Approximate Retail Value (“ARV”) of each Bandit® Tapegun is $4.00.

2. First Entry Period Prize: Five (5) Visa® Gift Cards. ARV: $25.00

3. Grand Prize: The Grand Prize is a weekend getaway for winner and one (1) guest to a destination within the contiguous U.S. of winner’s choosing (the “Destination”) consisting of: (i) round trip coach class air transportation for Grand Prize winner and guest between the major continental U.S. airport nearest Grand Prize winner’s residence and the major continental U.S. airport nearest the Destination; (ii) two (2) nights hotel accommodations (one room based on double occupancy); and (iii) all taxes related to the accommodations and airfare. Airports, airlines, flight itinerary and hotel will be determined by Sponsor in its sole discretion. Travel must occur between April 1, 2014 and September 30, 2014, and Grand Prize winner and guest must travel at the same time on the same itinerary. Blackout dates apply. ARV: $1,600.00. Actual value may vary based on airfare fluctuations and distance between departure and destination. Grand Prize winner will not receive the difference between actual and approximate retail value. No refund or compensation will be made in the event of the cancellation or delay of any flights. Grand Prize winner and guest are solely responsible for all expenses and costs, other than those specifically stated in these Official Rules, that may be incurred or arise as a result of being awarded the Grand Prize, including, but not limited to, ground transportation, meals, incidentals, gratuities, surcharges, airport fees, service charges or facility charges, security fees, taxes other than those related to the accommodations and airfare, personal charges at lodging, entertainment or other expenses. If Grand Prize winner’s travel companion has not reached the age of majority in his/her place of residence, Grand Prize winner must be travel companion’s parent/legal guardian. Grand Prize winner and travel companion are solely responsible for their conduct while accepting the Grand Prize and agree to comply with all applicable laws and regulations pertaining to use and enjoyment of the Grand Prize. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.

The total ARV of all prizes is $2,125.00. Prizes are non-transferable, and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute a prize or a portion of a prize of equal or greater value at its sole discretion. All federal, state, and local taxes or other expenses relating to the use, acceptance and possession of a prize are the sole responsibility of the winners.

6. Drawings/Winner Notification: Administrator is an independent organization, whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding. First Entry Period Prize Drawing: On or about January 16, 2014, Administrator will select five (5) potential First Entry Period Prize winners by random drawing from among all eligible entries received during the First Entry Period. Grand Prize Drawing: On or about March 1, 2014, Administrator will select one (1) potential Grand Prize by random drawing from among all eligible entries received during the First Entry Period and the Second Entry Period. All entries from the First Entry Period will be carried over into the Second Entry Period. Odds of winning depend on the number of eligible entries received for the applicable entry period.

Potential prize winners will be notified by email or telephone using the information provided on the entry form. Except where prohibited, the potential Grand Prize and First Entry Period Prize winners will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release, which must be received by Administrator within seven (7) days of the date notice or attempted notice is sent (“Notification Period”) in order to claim their prize. The potential Grand Prize winner’s guest (parent/legal guardian if guest is a minor in his/her place of residence) shall also be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release to Administrator within the Notification Period in order for the potential Grand Prize winner to claim his/her prize. If, despite Sponsor’s reasonable efforts, a potential prize winner cannot be contacted or the potential winner and/or the potential winner’s guest fail to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the Notification Period, such potential prize winner will forfeit his or her prize, and an alternate winner may be selected by random drawing from among all remaining eligible entries received during the Sweepstakes period. A potential prize winner will also be disqualified from the Sweepstakes, and an alternate winner may be selected, if he/she is found to be ineligible, has not complied with these Official Rules or declines the prize for any reason prior to award. Receiving a prize is contingent upon compliance with these Official Rules.

7. Release: By receipt of any prize, winners agree to release and hold harmless Sponsor, LePage’s Incorporated, Administrator, Facebook, Inc. and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason, including fraud, technical failures, human error or any other factor that impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information in these Official Rules or in any other Sweepstakes-related materials, whether caused by Sponsor, Administrator, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. No Association with Facebook: This Sweepstakes is in no way sponsored, endorsed or administrated by, or associated with Facebook. You are providing your information to LePage’s 2000 Incorporated, and not to Facebook.

12. Disputes/Governing Law: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in connection with this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Michigan.
